Syd&Co – Terms & Conditions

These Terms and Conditions ("Terms") govern all purchases of personalised clothing, accessories, and related goods ("Products") supplied by Syd&Co ("we", "us", "our"). By placing an order, the customer ("you", "your") agrees to be legally bound by these Terms.

2. Order Acceptance

2.1. All orders are subject to acceptance by Syd&Co.

2.2. We reserve the right to refuse or cancel any order where necessary, including but not limited to cases involving incorrect pricing, suspected fraud, or insufficient stock.

2.3. A contract is formed only when we issue a confirmation email acknowledging receipt and acceptance of your order.


3. Personalisation Requirements

3.1. All personalised details (including names, spelling, colours, and design choices) are provided exclusively by the customer.

3.2. Syd&Co shall not be liable for errors in personalisation arising from incorrect or incomplete information submitted by the customer.

3.3. Once production has commenced, amendments to the order cannot be guaranteed and may incur additional charges.

3.4. Customers are responsible for reviewing and approving all personalisation details before submitting their order.


4. Pricing and Payment

4.1. All prices are listed in pounds sterling (GBP) and include VAT where applicable.

4.2. Payment must be made in full at the time of ordering.

4.3. We accept payment via credit card, debit card, PayPal, and other methods displayed at checkout.

4.4. Syd&Co reserves the right to modify prices at any time; however, such changes will not affect orders already confirmed.


5. Production and Processing Times

5.1. Production times vary by product type and order volume. Indicative processing periods are provided on product pages or upon request.

5.2. These timeframes are estimates only and are not guaranteed. Delays may occur during peak seasons (including but not limited to Christmas, Black Friday, and promotional periods) or due to circumstances beyond our control.

5.3. We will notify you of any significant delays as soon as reasonably possible.


6. Delivery and Shipping

6.1. Shipping fees are calculated at checkout and depend on the delivery method selected.

6.2. Delivery dates are estimates provided by third-party couriers. Syd&Co accepts no responsibility for courier delays, lost packages, or delivery issues caused by incorrect address information supplied by the customer.

6.3. If an order is returned to us due to an incorrect or incomplete address, the customer will be responsible for additional re-delivery charges.

6.4. Risk of loss and title for Products pass to you upon delivery to the shipping carrier.

6.5. For international orders, customers are responsible for any customs duties, taxes, or import fees imposed by the destination country.


7. Returns, Refunds, and Exchanges

7.1 Personalised Products

7.1.1. Due to the bespoke nature of personalised items, they are non-refundable and non-returnable unless:

  • (a) the product is faulty;
  • (b) the product arrives damaged; or
  • (c) the personalisation applied is materially different from that requested, due to our error.

7.2 Non-Personalised Products

7.2.1. Non-custom items may be returned within 28 days of receipt, provided they are unused, unworn, unwashed, and in original packaging with all tags attached.

7.2.2. The customer is responsible for return shipping costs unless the item is defective or we have made an error.

7.2.3. Refunds will be processed within 14 days of receiving the returned item.

7.3 Faulty or Damaged Goods

7.3.1. You must notify us of any damage, defects, or errors within 48 hours of delivery by emailing contactsydandco@gmail.com.

7.3.2. Evidence, including clear photographs of the fault or damage, must be provided.

7.3.3. Syd&Co reserves the right to repair, replace, or refund at its sole discretion.

7.3.4. We may request the return of faulty items before issuing a replacement or refund.


8. Order Cancellations

8.1. Orders may be cancelled within 24 hours of placement, provided production has not yet commenced.

8.2. If production has begun, cancellation is not possible and no refund will be issued.

9. Product Appearance and Variations

9.1. Colours and finishes may differ slightly from those displayed on digital screens due to monitor calibration and settings.

9.2. As handmade and custom-produced items, Products may exhibit minor variations in placement, size, or finish. These are characteristic of handcrafted goods and do not constitute defects.

9.3. We make every effort to ensure product images and descriptions are accurate, but minor variations should be expected.


10. Intellectual Property

10.1. All artwork, designs, photographs, logos, illustrations, and other creative materials produced or displayed by Syd&Co remain our exclusive intellectual property.

10.2. Customers are prohibited from copying, replicating, distributing, reselling, or using Syd&Co's intellectual property for commercial purposes without prior written consent.

10.3. By submitting custom artwork or images for personalisation, you confirm that you own the rights to such materials or have obtained necessary permissions for their use.


11. Limitation of Liability

11.1. To the fullest extent permitted by law, Syd&Co shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the purchase or use of our Products.

11.2. Our total liability, whether arising in contract, tort, or otherwise, shall not exceed the purchase price of the relevant Product.

11.3. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.


12. Privacy and Data Protection

12.1. Personal information collected during the ordering process is used solely for order fulfilment, communication, customer service, and legal compliance.

12.2. We do not sell or share personal data with third parties except where required for payment processing, delivery, or as required by law.

12.3. We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

13. Discount & Promotions Policy

13.1 Discount Code Usage

13.1.1. Only one discount code can be used per order.

13.1.2. Discount codes cannot be combined with other promotions, loyalty points, review rewards, or any other offers unless explicitly stated.

13.1.3. Minimum spend requirements apply to some codes (e.g., £30 minimum for COMMUNITY10). The minimum spend is calculated before shipping and after any discounts.

13.1.4. Discounts apply to eligible products only and exclude premium items, sale items, gift cards, and shipping costs.

13.2 Exclusions

13.2.1. The following products are excluded from all discount codes unless explicitly stated otherwise:

  • New Premium sweatshirts and hoodies 
  • Changing robes
  • Bespoke drawings and custom artwork
  • Custom tweaks and special requests
  • Products already on sale or clearance
  • Gift cards

13.2.2. Some promotional codes may have additional product exclusions as specified at the time of offer.

13.3 Expiry & Validity

13.3.1. Review reward discount codes expire 14 days after issue.

13.3.2. Promotional codes may have expiry dates as stated in the promotional material or email.

13.3.3. We reserve the right to modify, suspend, or cancel discount codes at any time without prior notice.

13.3.4. Expired discount codes cannot be reactivated or extended.

13.4 Limitations

13.4.1. Discount codes cannot be applied to past purchases or pending orders.

13.4.2. Discount codes are for personal use only and cannot be sold, transferred, shared publicly, or used for commercial purposes.

13.4.3. Discount codes are limited to one use per customer unless otherwise stated.

13.4.4. We reserve the right to refuse or cancel orders where discount codes have been used fraudulently, in breach of these Terms, or in a manner inconsistent with the intended purpose of the promotion.

13.4.5. No cash alternative is available for discount codes.

14. Force Majeure

14.1. Syd&Co shall not be liable for any failure or delay in performing obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, supplier failures, or government restrictions.


15. Amendments to Terms

15.1. Syd&Co reserves the right to amend these Terms at any time.

15.2. Updated Terms will be posted on our website with a revised "Last Updated" date.

15.3. Continued use of our services following any amendments constitutes acceptance of the revised Terms.

15.4. Terms in effect at the time of your order will govern that transaction.


16. Governing Law and Jurisdiction

16.1. These Terms are governed by and construed in accordance with the laws of England and Wales.

16.2. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.


17. Severability

17.1. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.


18. Entire Agreement

18.1. These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Syd&Co regarding your purchase of Products.

18.2. These Terms supersede any prior agreements, representations, or understandings (whether written or oral).
